A 21 yr old man having sex with a 15 yr old isnt a criminal case?

One would think it is, but she filed a lawsuit, or at least that's what I gathered from the article. I would have thought the DA's office would have filed suit. Maybe I'm just reading something that is not there. I would think that the statute of limitations on statutory rape is more than 2 years.
