It works like this Matt, if the lawsuit is bogus, the jury finds for the defendant.
ROFLMFAO!!!!!!!!!!!!!

That's hillarious, Goober. Really. Excellent comedy.

The jury finds for whoever puts on the better show in these cases.

Take a CP case. If the plaintiff has a charismatic, ethically bankrupt lawyer who can put on a good show of claiming to channel the (not dead) child, the jury returns a sympathy verdict.

Throughout the country, there are attorneys who capitalize on the scientifically flawed position that every birth defect is caused by a doctor who must then pay millions.

Oh, yeah, and the lawyer gets half (typically 40% plus costs).

Remember the OB/GYN that Bush brought up onto his campaign platform and introduced as a doctor forced out by high premiums, the reason this doctor had to pay high premiums was because one time during the delivery of a baby, he got hungry, and went out and got something to eat, leaving the patient unattended, and leaving the baby to suffer irreparable brain damage.

Imagine, the insurance companies raised this guy's premiums.
For every one of those, there are probably 20 OB/GYNs who have never even been accused of malpractice paying six figure premiums.

If they don't leave the specialty, that is.

Every time you hear about how some poor malpractice victim was awarded millions, just remember - the lawyer walked off with half (or more). And then next time you pay your health insurance premium, understand that the costs you pay are directly related to the costs of these suits on the medical industry as a whole.
