a fence should be up yes, but not everyone can afford a fence for so much land. even if the dogs were tied up or on leash, if the dogs attacked it would have just made it harder for mr.p to protect himself, and the situation i think would not be very different at all. but i agree, time for something to die, i would have the dogs killed if they came on my yard.
