If I found someone's wallet with $1,000 and a DL and didn't return it it would still be called theft. To have property that belongs to someone else and not return it is theft. Also you don't know if the dog hadn't been stolen unless you talk to the original owners. The fact that the dog had been cared for before this guy found it means that someone cared for the dog and probably are really missing it. I'd at least give the owners a call.

Recently when I took Molly to the vet a guy was in there looking for his JRT. It had gotten out of the yard and disappeared. It had a tag with his address and phone number on it. A week later someone called him asking if he had lost his dog. He told them yes and never heard from them again. He was going around to all the vets in the area and posting a notice on the bulletin board in hope that whoever found the dog would take it to a local vet.
