The way I see it, it is a declaration of war against a person, who intends to attack the Nation and aims to kill US citizens.

If accepted as such, it would be legal.
All sorts of things can happen in respect to Presidential power. However technically only Congress can declare war.

Would it not be better to ask those who have the authority within the country he is expected to be hiding to apprehend this fellow (at their desecration) by what ever means and force necessary ?

If one man can "under the laws without trial" in our country call for the death of another citizen that power may be justifiably transferable to anyone. (at least in their mind.)
