Actually, as long as it is not purchasable on any commercial format then I think its fair game after it has been broadcast. Which is how sites like UKNova continue to exist.....

EDIT - Now that I think about it, that may just be for free-to-air channels, so you might not be able to download things that are on channels only available through sky or virgin or whoever

Not really. Any production is under copyright and therefore any unauthorised copying is illegal.
