So he has offered to refund your deposit and is backing out of the deal..... Whats the problem? You get your money back what more are you looking for? Move on and find another person. You haven't lost any money, you actually come off as a tw*t. I would say since he isnt screwing you out of anything but the time it took to find and hire him just move on.

Oops, I missed the "refunding the deposit" and "backing out" parts of the parent post.

To be fair, he should find you an adequate replacement (not that he should pay for it).
