Well lets put it this way:

We cant find a videographer now.

He has failed to provide us with any alternative.

So we are getting it done by a member of the family so we have something.

Therefore we may seek damages against him since he pulled out so late.

Let's not put it that way, you are the one that brought contract law into it, so did you have a WRITTEN contract? If so, what are the cancellation terms? As noted, a refund of deposit almost definitely extinguishes his liability.
