If they knew you were going to commit the crime they could simply prevent the crime. No need for jail, just a small fine for the police having to intervene.

Of course since the future isn't set in stone (or so I assume) it's impossible to know the crime will happen for certain.
I agree. Jail would be unnecessary but charge the person and probably a tracking form if he tries to lie low for a while then do it.

However, realistically how would this be pulled off? Unless you are a really knowledgeable person about crimes and patterns to know if a person will do it or not but to find that out you will have to gather personal information illegally.
