Regardless of how many you've had, if you blow a 0.08 (or whatever it is where you are), you are legally drunk and should be prosecuted. There should never be leeway in DUI cases. Its a serious crime and should be treated as such.

As for this guy, he should be put away for a long time. No sympathy for drunk drivers. [cursing]

If a .08 is defined as legally drunk, then alcohol should be illegal and not served in restaurants. The lunacy of how few beers is actually needed to throw your ass in jail is astounding. This guy killed somebody, so obviously he deserves to go to jail for a very long time. However, he was probably 3x over the legal limit.
