If their business is failing to the point of bankruptcy what exactly do you want them to do for their employees? They can't exactly magic money out of nowhere that's the reason they are bankrupt. Odds are the reason they hadn't informed their employees earlier is they were desperately doing everything they could to keep the company from going under looking for more credit, potential buyers, etc.
