Ya, there is a $20 discount for iPods still in stock that don't already have the new firmware. The software update is because the iPod isn't a subscription plan. The iPhone gets free updates because Apple gets around $240 for every iPhone user just from the 2 years with AT&T. That helps cover the development cost of updates. Since the iPod Touch wasn't really a bug fix but more a "extra features", kind of like buyings games except apps there was a price put on it. I'm sure if there are bug fixes they'll be released for free.
