I did something very stupid in 2007. I got in a tight and went to a place that is essentially a payday loan place, but I feel their contracts operate right within the fringe of the law. Summary: 1. I borrowed 200 in 2007 and wrote them a post-dated check. 2. To pay off the loan it would have cost $287.00. 3. I never had the 287.00, so I would go in, and essentially pay the interest on the loan - 111.00 and some odd cents. They in turn would hand me a check for 200.00 made out to me, which I would sign and hand right back over to them, along with the 111.00 in CASH ONLY. 4. This rocked on for a year, and when I realized I had paid them over 1200.00 I decided I was not going to pay anymore. 5. Today I got this voicemail to call this investigative company, so I did. This obnoxious windbag got on the phone screaming my social security number - i.e. is that your number, he was screaming so loud, he could not hear my answer, yes. Then he says he is going to file with the magistrate and get me charged with writing bad checks. He is hollering and screaming so loud, I just hang up after he told me his address and to be in there by 4:00 o'clock today with 287.18. 6. I google payday lending in my state, it is against the law. But again, I can't find the damn contract, I feel they are operating just within the boundaries of the law. I get a phone number to the state and the guy calls me back, says payday lending is illegal. 7. The kicker is, I have 300.00 bounce protection on my checking account. I don't think they have even put the check in because it is over a year old. So how can I be charged with writing bad checks when I don't think they have even tried to put the check through? 8. I want to shut these fuckers down. I would rather pay a lawyer double what I owe them. 9. Windbag referenced under #5 threatens me, You can pay me or you can pay Sentinel probation 700. Off topic, but I was arrested legitimately in 1996 and was on unsupervised probation for a year. I had to pay a fine of 100.00 a month, do community service, etc. The last day I went in there to pay the last of the money, this caseworker says, no now you need to do this and that, pay this much more, I said no, you don't understand, I have never been charged with this offense in my life. She says, you are wrong you still have to do this and this and pay this and that. I say okay. I go across the street to the superior court and get a freaking notorized blue-backed copy of my original court order. I walk back to probation office, they tell caseworker someone is there to see her. She opens up the door and sees me standing there with legal document in my hand and she says, "Oh, I must have made a mistake". Point being, they were going to take even more money and had I not had the wearwithal and knowledge to walk across the street and get a copy of my court order. 10. Back to #7 -how can I be supoened for writing bad checks when I don't think they have ever put the check through. 11. In summary, refer back to #8.
