the opinion of Imam Malik (Rahimullah) and Ikrimah (Rahimullah) went against the jahmur of the other schools, their argument was based on the quranic verse,

فَكُلُواْ مِمَّا أَمْسَكْنَ عَلَيْكُمْ وَاذْكُرُواْ اسْمَ اللّهِ عَلَيْهِ وَاتَّقُواْ اللّهَ إِنَّ اللّهَ سَرِيعُ الْحِسَابِ

(Say: lawful unto you are (all) things good and pure: and what ye have taught your trained hunting animals (to catch) in the manner directed to you by Allah) ”eat what they catch for you, but pronounce the name of Allah over it: and fear Allah; for Allah is swift in taking account.” (5:4)

Also Imam Malik is quoted extensively in the Mudawwanah regarding the purity of the dog (see volume 1)

Now the Qadi Ibn Rushd (Rahimullah) does offer a dissenting opinion and states that perhaps Malik himself was not aware of the hadiths (dogs being najis) but even if that was the case Malik would still stick with his opinion because he would follow the book of Allah since its meaning was apparent.

As for keeping dogs as pets, I have heard that many fuqaha have allowed it based on the numerous sharh of Imam al-Qayrawaani’s Risala.
