yes, unless the dems controlled both houses as they did the first 2 years of obozo's term.

and think about this, how many SCOTUS appointments will come up in the next 4 years. do you want 3 or 4 more kagans?

I don't know that it matters.. Congress could check THEM too if they'd only do so.
