The ACLU is defending NAMBLA, pro-bono, because they believe NAMBLA’s speech should be protected under the 1st Amendment. The case is still before the courts. In the past the Court has often allowed speech such as this to be protected because the Court reasons that such speech does not pose an immediate danger of an unlawful action.
