It's not the policy to not scale them either. How do you know that? If it's in the policy, then the employee did not follow instructions set out for his own safety.
Whether they were negligent in not training employees to refrain from it may be a debatable issue, but it wouldn't help the owner in any event. From what I can see, the employee was not injured, warning shot was fired, issue settled. What would you charge the homeowner? Unlawful discharge of a firearm?
