How can anybody sell a land without document of ownership?
Selling "a black cat in a bag"? As far as I know, if you cannot process the legal documents of ownership, you dont own the land. I bought 200 rais without docs. just the contract between buyer /seller and I own it I can do anything I want, farming, (built one house on it) and I can sell it if I choose, I benefit from the land by leasing it to the farmer and you can not develope it, the purpose is for agriculture only at this time have to wait untill the zone changed then you can obtain the red deed and make big profit How do I know that the change of destination has been done legaly? Go to the city of record where the land is located and check the title. The local Land Department would change the destination of this land very easy. Lots of people have done this before with succes in order to built on it or to sell it. But is this legal and is it registrered at the head Land Department in Bangkok? One of these land deeds, has a GREEN Garuna symbol on it and are called "˹ѧÊ×ÍÃÑ¢Ãͧ¡ÒÃËÓ»ÃÐâ¢è¹í". It is meant open land or abandon land or the GOV. provided land so Thai families have places for agriculture you are the owner of the land but can not legally sell it, some still do without document of ownership How can anybody sell a land without document of ownership? If you have this deed it is legal by law to sell as the owner or to build on. One of these land deeds, has a GREEN Garuna symbol on it and are called "˹ѧÊ×ÍÃÑ¢Ãͧ¡ÒÃËÓ»ÃÐâ¢è¹í". Or event you assign someone to move in and over look the property without charge the rent, you have to have valid contract to prove that you are the owner of the property let say land lease 10 bath per year and end in so and so year.
That's what was done with the rice field. As I've explained in my first post, my wife owns also a big rice field. But this rice filed has a RED "Garuna" symbol. Originaly, this rice field was also on a GREEN deed and only for farming. My wife leased the rice field to another farmer in return for 10% of the harvest. This year she went to the Local Land Department with the land deed, and we got a new RED deed. If she wants to sell it now to a real estate agent, it's worth millions of Baht. Regards, Nakreeyang |

Yes it is a gambling, buying land without title it is very risky unless you plan to move in or someone you love to live in to stay claims as owner. It is not for any Thai as investment it is for local Thai that capable to over see the property at least once a month. because if somebody sneaks in and build the hut/camp and live in without you notice and farming or make benefit from the land after 10 yrs. they can claim as the new owners. As the green deed indicated it's GOV. provided land for people to benefit from using the land for living. I dont know if this is the right forum to post this question. If not, accept my apologies. My question: I have seen different land deeds, owned by my wife, with or without a house on it. Some of this land deeds, have a RED Garuna symbol on it and are called "⩹µ·ÕèµÔ¹". One of them is a plot of land with a Isaan house build on it. Another is a "big" plot of land, used as a rice field. One of these land deeds, has a GREEN Garuna symbol on it and are called "˹ѧÊ×ÍÃÑ¢Ãͧ¡ÒÃËÓ»ÃÐâ¢è¹í". My questions are: - What type of land is on a deed with a RED and GREEN Garuna symbol? - What is permitted/forbidden on each of these deeds (can I build a house on the plot of land with the GREEN land deed)? - Is it possible to change the destination of a plot of land (GREEN land deed to RED land deed and vice versa)? If you are Thai, you can the risk and if everything goes well make big profit in a few years. Buying land without documents is a gamble for every foreigner, and I doubt strongly that a foreigner could make benefit of it. Go to the city of record where the land is located and check the title. By now, you will know that I'm a foreigner and showing my face in any Land Departement Office for these purposes is a "no-no". My wife will have to make the change of destination at the local Land Departement Office and do all the paperwork. When the change of land status is occurred meant from green to red deed it is recorded at local city record where the land is located. I will believe you on this, and let my wife try to change the document from GREEN to RED. If they would agree at the local Land Department (which at this "electoral" moment is almost 99% sure), I can start buiding our house. Thanks for your useful replies, Nakreeyang |
