Just in, Bail plea for Kanimozhi and Sharad Kumar dismissed by Delhi High Court in the 2G Spectrum case
From Zee News The Delhi High Court, Wednesday, rejected the bail pleas of DMK MP Kanimozhi and Kalaignar TV MD Sharad Kumar, accused in 2G spectrum allocation scam case. Justice Ajit Bharihoke, who had reserved his orders on May 30, rejected the strong pitch made by Kanimozhi’s lawyers that she had no role in the allocation of spectrum. The learned judge only read out the operative part of the verdict. He said that as Kanimozhi and Sharad Kumar were recipients of gratification and as they have considerable social and economic, so they may influence the case if granted bail. Kanimozhi, who was present along with her family members and supporters, broke down on hearing the verdict. Justice Bharihoke had recently dismissed bail pleas of five corporate honchos, including Unitech Group MD Sanjay Chandra and Reliance ADAG MD Gautam Doshi in the case, saying there were chances that they may influence the witnesses. Kanimozhi, the 43-year-old daughter of DMK supremo M Karunanidhi and Kumar were named by CBI for allegedly receiving a kick back to tune of Rs 200 crore. Both Kanimozhi and Kumar have 20 per cent stake each in Kalaignar TV Pvt Ltd which allegedly received Rs 200 crore through a "circuitous" route from Shahid Balwa promoted DB Realty. DMK chief's wife Dayalu Ammal, who has been left out of the list of accused, owns remaining 60 per cent shares in the channel. Kanimozhi and Kumar had moved the High Court on May 23 challenging the trial court's order which had rejected their bail pleas saying the offence attributed to them was grave and the possibility of influencing the witnesses cannot be ruled out. |

Dear forum mates,
It seems that the judiciary is now given the free hand to make judgements on their own without political influences. My presumption is based on the fact that the judgment has come after the result of the Tamilnadu elections in which the DMK was routed. But still the punishment for economic offences committed by politicians have not yet been streamlined or made stringent in India. This type of partial legal action will definitely encourage the prospective offenders of Law . Hope the Forum mates would agree to my view. Thanks and regards. Ravichandran S |
