Cathy Cruz Marrero became famous overnight after a mall security video (below) showed her tripping an falling into a fountain face first when she failed to see the fountain because she was busy texting. She isn’t happy about being famous for being foolish. She said:"Instead of laughing, they should have said, ’Is she okay?,’ and been down there right away to check on me."Marrero’s complaint was that mall security didn’t respond to her fall until about 20 minutes later, but by then she had left the mall.

Her attorney, James M. Polyak of Reading, said he plans to conduct an investigation into what happened."We are troubled by the fact that anyone at the Berkshire Mall responsible for releasing this video would find humor in an employee injured on the premises. We intend to hold the appropriate persons responsible.""No one from that security office came to her aid in a timely manner."
I don’t think Marrero is going to get any money for her mistake, even if she sues. There are laws that forbid people from texting and driving for the same reason a reasonable person should know texting while walking could also result in an injury. It doesn’t appear that Marrero was injured. Although security didn’t respond right away, a maintenance man was offering his help right after he saw a dripping wet Marrero walk into and out of a store, but she apparently refused. The other issue Marrero will need to explain how she could miss a fountain she must walk by daily since she works in the mall, and could have only missed if she was distracted by something like sending a text message.
By hiring an attorney Marrero is just further demonstrating her lack of good judgment, and has increased the cost of this lesson in personal responsibility.
