How soon is soon? I'm thinking of just buying an iPhone 4 on AT&T selling that and getting a Nexus One.
I can get anything on any carrier now. I am done with my contract with att and have been using a Nokia N79 unlocked.

Nexus One looks OK, but there is there a 3G version for ATT? I want to stick with ATT or Verizon.

The heart of the matter is this - I own the hardware, I should have every right to modify it with the available, FREE, open source software as I see fit. No, i don't expect warranty, but otherwise....
dude like said, yes you may own the hardware, but you purchase it under the terms and conditions given and those clearly say (i guess)
You mod this product and itīll destroy itself.

In purchasing my phone(s), i have never been presented with any such terms, nor would I agree to them.

Furthermore, in my mind, if i have paid for the hardware outright, there ARE no terms and conditions to it. Terms and conditions only apply in contractual situations, and me owning the phone is not ruled under any contract (the cellular service for the phone is contracted, but done so independent of the phone). Again, they have NO RIGHT to rule what i do with my purchased hardware.

well i guess in reality it is a buying a cat in the sack thing,
the terms and conditions are in the booklet/manual inside the actual package, which you can in most cases only access if you have already purchased the product.

1. EULA is not a binding agreement. Every court thus far has said so.

See:
Step-Saver Data Systems, Inc. v. Wyse Technology
Vault Corp. v. Quaid Software Ltd.
ProCD, Inc. v. Zeidenberg
Microsoft v. Harmony Computers

etc...

2. No contract is legal unless it meets the "conscionable" standard.

3. This was a stupid decision on Motorola's part. All they will do is make a number of lawyers (who prosecute the class-action suit against them) very rich... and piss off a good proportion of the very people who would buy that phone.

Just consider - people who aren't more technologically-inclined would probably buy another phone.

I just read about it,
apparently it is only a binding agreement when the EULA has been made present before the purchase.
According to Wiki License/Terms that are made/given after the purchase (like in form of a booklet/manual inside the package) are actually non binding.
Interesting.

When you go to buy the Nexus One, you will find you have a choice between the AT&T one or the T-Mobile one.

Being in Canada, I hope to get an AT&T version soon. My Magic is excellent, but I'm itching for more power.

Sure enough, I see that now on their site.

So when you get an iphone 4 you sign a new contract, then sell the iphone? Don't they open it and activate and all that?

I might go a different route...I just found the ATT Captivate, avail this week. While it sucks because ATT locks it down, I found a website that shows how it can be easily rooted to the stock Samsung S firmware, which eliminated all the ATT stuff, and adds in features. Also should mean earlier 2.2 update.

Hmmm. Nexus one will always be first...but it is a little spendy, and the hardware isn't quite as good as the samsung s phones IMO.

Ok its been rooted... Doesn't mean you can load custom roms on it. Efuse will still block it. But its a step in the right direction.

Yeah. At least now Droid X users can get rid of all the crap loaded on to it.

Excuse my ignorance, but what bloat/junk is there to remove? You guys talking about motoblur?

I am not gonna try this on my phone as I don't even know of or have something I'd want to do this for.

You could remove blur, yes. I don't know all about droid x, but on the droid I got rid of: amazon mp3 app, corporate calendar, car home, visual voice mail, facebook, news and weather.
I know the droid x comes packed with even more stuff though like twitter and facebook crap I'd never use.

Ahhhh ok yea, it has those. The motoblur I like, and it runs smootly. That other stuff you mentioned I have not even opened. Facebook I used but not other social networks. Ah well I'll prolly deal with it until I read up to a point where I feel the rooting is simple for me to do....if I come to the need to.

Yeah, I would hold off on rooting until they make an app for it. Rooting at the first possible opportunity is always arduous.
