Default Legal police advice?
Last night i had an a incident with the neighbours, the parents where away and there 14 year daughter had some drunken yobo lads around.
They started hammering and banging the joining wall and laffing and shouting at 11pm, this carried on at different intervals till 4am, i shouted for them to stop a few times which they did for a short period.
When it didnt stop i went around and knocked there door on 2 occasions as they didnt answer i knocked the door loudly, at 4am i rang the police and told them what happend a squad car came later but they didnt anwser the door to the police either.

Earlier today i saw a police man living there house so i asked what was happening and he said the neighbours said i have damaged there door and the damage looked fresh and if i was co-operating i would get a caution.
This is bulllshit i was victimised now they want to give me a caution, what can i do as i dont want a caution as were taking anti-social behaviour precedings against them and a caution will look bad.

Did you hit their door hard enough for it to leave a mark? Maybe you scared them? As you say, she is only 14? You know her well?

Can they prove it was you who caused the damage? I would say that if you had to call the police because of rowdy behaviour - which the police then witnessed - you could claim that the damage was caused by your neighbour and their friends(You could, but don't state that to the police at this time).

The police can't prosecute you without proof and are probably just using the caution angle to save them the paperwork. I would contest it and deny it was you who caused the damage. Don't get smart with the police but just politely state that you don't believe you are at fault.

If you accept the caution it will still be held on your records and could be used against you in the future if you are involved in any other police matter.

Tell the pigs it was your neighbors daughter who damaged the door with her head while she was being ****ed from behind by one of her drunk boyfriends.

I'd plead ignorant to the cops and deny that you damaged the door, since you'd not only get the caution, but be liable to pay for the doors repair or replacement by the parents of the 14 yr old.

Besides, it sounds like the 14 yr old is in the sh*t, so a bit more about the damage to the door is not going to make much difference for her.

Probably drinking, illegally, maybe having sex, illegally, She's probably gonna get grounded, forever, so f*ck 'em, make the parents pay for the damage, if they try to force the issue, just say the door was like that, when you got there and in their drunkenness the daughter and friends probably didn't notice the damage until next morning and then decided to blame you.

Don't admit to anything to the cops and don't take a caution either, cos like it or not, it'll always be on your record in some way or another.

If you damaged it - accept the consequences.

If you did not - then please stand up for yourself, deny it, and get them to prove it.
If you are innocent - don't take this sh!t.
A caution goes on your record I believe. Why tarnish your reputation especially by a rowdy ill disciplined 14 year old Chav b*tch who will no doubt bring nothing constructive to society when she is an adult.

Ive been to see my local neighbours who have had anti-social and horrible behavour agaisnt them, been given 3 officiers names to talk to about the troublesome family as there well known and disliked for wasiting police time ober the years.
Hopefully i can get some good advice on how to preceed before have a meeting about the caution, i really feel like i should get a oral warning for knocking there door loud at night at worst.

The yobs have been seen by the nieghbours being rowdy and nearly wobbling a lamp post over, and the nieghbours on mky opposite side had 2 fence boards kicked through but that wasnt witnessed, i also had bag cramed full of empty rocket fuel alchopops, dumped just outside my house probly due to her mum coming back in the morning.

Relik after i knock the door they still banged and laughed so i very dought she was scaied.

Snoopy she wasnt grounded as i seen her playing out at 9.30 at night, the parents dont care if the kids are horrible to someone they dont like.

Quite frankly, I would refuse to take the caution and let the Police take me to court.

If the family is as bad as you say they are, its likely the judge would throw the case out of court or the CPS would not even decide to let it get to court and you'll get off scot free, either way.

Do the troublesome teens parents own their own home or rent from a private landlord or council?

If they rent, I would put together a statement of everything that happened that night and send it off to the landlord/s, hopefully the tossers will get either evicted or be on their last warning.

Law abiding citizens, minding their own business and paying taxes shouldn't have to put up with scum like this.

I bet if you decide to take the caution the police will let your horrible neighbours know about your decision, and you'll probably have them laughing at you behind your back, because they've effectively Won and you've been the one to get a caution when its their teen girl that was causing the sh*t in the first place.

I'd tell the cops, Do your worst, cos I'll fight this with every breath in my body, then see what happens after that, they'd probably think its more hassle to pursue any case against you, rather than just give you a verbal warning and tell you to just call the cops next time you have trouble from your neighbours.

Unless you attacked the door with an axe, any damage will be superficial and not even worth the neighbours time pursuing you in the small claims court, its likely they'd lose anyway with their past history of behaviour, etc.

They live in a Council House and is the only council house in this row of about 12 terrace houses.
The officer that mentioned the caution didnt ring today like he said he would, thinking back he said the damage looked fresh but this isnt proof is it.
Council have been around to do work on the door spent about 40 mins on and off some hammering and drilling the door and frame look identical to me.

I went to the police station i spoke to a officer he mention if i was to get a caution it should have been done at the time, i wasnt arrested and they need to prove i did the damage.

Should have got a police report when the cops came round the first time and should have made sure that they would come back later in the day.

I would leave it at that then.

Seems the cops might have been waiting for you to admit you damaged the door and the caution threat might have been their way of trying to wrap up the incident.

Next time, you get problems, call the cops (which will quite likely result in them doing absolutely f*ck all about it), So just keep a written record of what happens, times etc, Maybe even take a sneaky video through the curtains or record the noise etc.

Then after several months, present it to the council/landlord and see what happens then.

Or just murder your hideous neighbours and hide them under your new patio.

Yeah, I agree with Snoopy - I would just leave it how it is, it sounds as if they aren't going to try and prove it was you and therefore the police wont do anything about it.

And yes, if it happens again just try and record it or create some kind of proof and call the police straight away.

If they try and accuse you of doing anything again set up a small courts claim against them for antisocial behaviour or something. As soon as they get the letter they have to go to court in a few months they'll drop whatever bullsh!t they're trying to accuse you of and leave you alone.

I did this to a landlord when he didn't pay back my deposit for any reason. He then decided he wouldn't pay me back and was willing to go to court - he ended up paying it back, paying all my court fees and my dad's and my salary for that day of work we missed to go to court [thumbup]

I dont really understand how the police work surely on the day they went to get the statement from the scum, look at the door for damage if they was proof or a witness i was to blame police would spoke to me by now?
