See here for how to do it (look under "Guides"). And yes, it's very easy. Although I don't think you can do 3.1 with a PC yet.

Well they would wouldn't they? If you've payed for the phone it's yours to do with as you please. How can it be "illegal"?

When I was looking at doing it I got conflicting reports of whether or not I would have to restore my phone to factory settings at some point. Whether that point was before doing the Jailbreak or when removing the Jailbreak, it kind of put me off as I dislike the idea of losing all my contacts / SMS's etc

As for Jailbreaking, Apple may dislike you doing it to the extent that they will void your warranty if they can prove you've done it but there is no law that I know of on which they could charge you. Not even sure they could do anything if you unlocked the device as the product is yours. So long as you've paid for it through PaYG or a contract ... that's that.

All you do is backup you phone in the current state and if you do a restore from that date that you backed up, all of your texts, contacts, etc. will be restored.

To the OP, it sounds like you are very new to the phone. Why not wait at least a couple days, see what is on the app store, familiarize yourself with the phone and actually use it just a bit before attempting to void your warranty?

It is a grey area for sure and it is not recommended, technically it is not. There are many things that are illegal that can be done with a jailbroken phone though.

The only moderately tempting thing for me about Jailbreaking is to allow my Sling Player app to be used over 3G instead of needing Wifi. The idea of watching Cable Television everywhere I go is quite luring, but I just don't think it outweighs the risks of Jailbreaking it.

I think the general understanding is that jailbreaking the iPhone/iPod touch isn't technically illegal however downloading and installing the cracked apps is.

I assume by "cracked apps" you mean the apps that you can get for free that you'd normally have to pay for in the App Store? There are plenty of apps you can download that are made by third parties that have nothing to do with the App Store.
