Oh damn. I'd be pissed too.
She filed for divorce in July 2005, although he claims she began having an extramarital affair 18 months to two years after receiving the kidney transplant, his attorney, Dominick Barbara said. Thanks for the kidney. BTW, I'm cheating on you. I know women take everything when they leave you... but damn that guy got hosed over hard. |

We don't want to set a precedence here. Imagine if he was awarded damages for his kidney. What would that do to transplants in America? We'd have lawsuits for all of them. So his marriage didn't work out, he apparently did something wrong. According to the article, she cheated on him after the operation. Now if she were cheating during the time frame of the operation I think this would be different, but just because she got a kidney from him, is she now stuck with the guy for the rest of her life even if the marriage isn't working out?

Yes. If I give someone I love a kidney and she cheats on me, I'd want that **** back too. Getting your life saved through such an extreme measure and sacrifice and then stabbing said person in the back is inexcusable. We're talking about more than just some assets and money here. Maybe he was the perfect husband and she just didn't get along with him anymore. No matter the reason, it doesn't really matter. Before the operation he had to sign documents that waived any of his rights to his kidney. Once it was removed from his body it was no longer his. He "gifted" it to his then wife. You cannot receive money for a gift. Not only that, but selling your organs is illegal in this country. Once again I'll reiterate my earlier point. If he were to win a case like this in the US, it would set a horrible precedence. Anyone who donated an organ and was later treated badly by the recipient would be able to sue for damages and probably win due to the precedence set in this case. |

True, but it's a sad world we live in when people treat the person who effectively shortened their own life to save theirs poorly. [thumbdown] Edit: below isn't directed at you Zortoflaven, just anyone who is on the side of the Dr. If the organ came from an anonymous donor, would you expect her to be in debt of the donor for the rest of her life? It's an amazing thing to be able to save someone like this, but to expect something in return is wrong. |
