Niqab is wajib according to who and when?

http://discussworldissues.com/forums...lies/salam.gif

I know this point has been argued over many times but due to the recent issues concerning niqab, i would like to bring it up.

Many people who have accepted niqab to be wajib all there lives are now beginning back down on their views and some ulama are also advocating this.

I would like to know which of the madhaib and ulama deem niqab to be wajib and if this ruling depends on the time and place and also the situation.

Please provide refs and quotes if possible.

For now please keep it limited to those who deem niqab to be wajib. We can start a different thread for the opposing view.

A good starting point would be Mufti Husain's The Niqab and its Obligation in the Hanafi madhhab

illiniastibly 07-19-2010 06:06 AM

From 'The Niqab and its Obligation in the Hanafi madhhab'.

3.1.1. A gaze accompanied with conviction of no possibility of attraction

This is the case mentioned in most texts and which has been misunderstood by many. The ruling of the imam’s of the madhhab is clear in that this gaze would be permissible.[7] Has there ever been a time where this was the case in the whole community and therefore niqab was not needed?

there is a difference of opinion on the issue. However niqab is clearly an islamic concept and is not cultural or a bidah like some idiots make it out to be. May ALLAH bless all the sisters who wear niqab ameen and give more taufeeq for the other ladies to also follow suite.

As-salamu 'alaykum

In the Shafi'i school it is considered a Fard according to those scholars who take the opinions of Nawawi and Rafi'i as authorative. For those who take the opinions of Imam ibn Hajr al-Haythami to be authorative, it would be considered Recommended with the possibility of being Fard under certain circumstances.

As for our beloved brother London786, we should be careful before we talk. Did you know that many of the early major Maliki Imams considered it Makruh. I have also seen this quoted as the mashhur of the school. However, the ruling would differ in front of non-Muslims.

Sources please.

Additionally, were these scholars in the majority (numerically)?

May I have a reference for this please?

This is what I fail to understand about Muslims, always making things harder for themselves. If the guy Hanafis follow namely Abu Hanifa said it is permissible for a woman to show her face, hands and feet, then why do you people insist on putting a cloth on a womans face? If the command was as clear as some of you make it out to be in the Qu'ran, why was it not 'wajib' according to him?

Because he never said it wasn't wajib.

Why are you concerned about the views of Imams if you don't follow them anyway?

BruceCroucshs 07-21-2010 10:31 PM

Assalaamu 'alaykum

opinions of Imams? fataawa? wajib/not wajib???

Is it not enough that the Ummahaatul Mu'mineen and the Sahaabiyaat covered up during the time of the Prophet sallallaahu 'alayhi wasallam and the Sahabah?

...surely this should be enough for even those who do not "blindly follow" a madhab?

I'll ask sr Idil the same thing I asked br hoohoo in the other thread.

Have you studied Usoolul Fiqh?
May I ask what the relevance of that question is insofar as this thread is concerned?

The thread is simply asking to know what the opinions of Ulema are, not to evaluate the strengths and weaknesses of their opinions (which as laymen we are not capable of) nor to even try to understand how they reached their verdicts.

The OP is also asking about the madhaahib. I'm sure you know that a madhab's rulings are not only based on the one scholar alone. So even if Imam Abu Hanifa has not mentioned a thing about wujoob of niqaab, the other scholars of the Hanafi madhab have. Anyways, you are right, no point asking that question. I'll delete my post.
