Default Keeping dogs as pet in Maaliki madhab
Assalamualikum wr wb to All

I wondered if anyone could help me with a question regarding the Maaliki madhab.

I understand that they regard all animals as pure, including dogs and pigs, but is it allowed to keep dog as a pet in the Maaliki madhab? [i.e, not as a guard dog or hunting dog, but just as pet]

Some people are rightly or wrongly going around insinuating that as the Maaliki madhab considers the dog as pure, it is ok to keep them as pets; so if they are wrong, I can refute them inshAllah

What about dog's saliva in Maliki madhhab? I know it's deemed pure in Maliki madhhab but what about praying with dog's saliva on one's cloth? I read in a fatwa on SunniPath that however one should wash it off because RasuluLlah said to do so; but someone says that there is no problem since it's deemed pure..

What's the correct stance?

Wow,i guess you learn something new everyday. And I thought that dog saliva was impure and that was across the board in all the school.

to add and clarify I believe the mashur opinion is its haraam to keep a dog for just a pet.

What about dog's saliva in Maliki madhhab? I know it's deemed pure in Maliki madhhab but what about praying with dog's saliva on one's cloth? saliva of all living creatures is considered pure in the Maliki madhab.

As the brother Muhammad Nur said above, I read in The Guiding Helper which is consider authentic, that the dogs & even pigs are pure including their saliva.

And the prayer offered with the clothes with their saliva, or urine is valid - w/o washing.

With that being said, why is it haram to keep it as a pet, and what's the daleel for this? It seems to contradict the idea of dogs being pure. (How can taahir be haraam to pet.)

Also, are there any Maaliki scholars who disagree with dogs being pure?? Is this what the Imam Maalik (Rahimahullah) said about the dogs?

There are two ahadith that I remember regarding dogs. One was where Rasulullah (saw) wanted an area in a house washed because a dog had been sleeping there and another where it says that malaika do not enter the houses of those who keep pictures and dogs.

Dogs and their saliva are not taahir. According to the Shafi's, even the hair of a dog is najis (Shafi' brothers can correct me on this).

Yes brother, I know about those hadith, and there is also a hadeth about washing the dish that's been licked by a dog 7 times, one of them with soil.

However, what I'm asking here obviously is about Maliki fiqh, not Hanafi nor Shafi'i.

They are not haraam to pet (meaning touch\pat) but to keep with out need according to one opinion and makruh according to the other opinion. And I believe this relates only to keeping the dog in your home as a pet I'm not sure if it differs if you keep it outside. And the hadiths that Abdulwahhab posted would probably be the reason for the prohibition or disliked nature of keeping them indoors.

From the Guiding Helper:

[As for keeping a dog (an animal from the Canis familiaris family)
in one's residence, it is mubah if one has a need for the dog
(e.g., guard-dog, seeing-eye dog, hunting dog, etc.) and is
disliked if one does not have any real need for the dog (e.g., a
pet dog).]

And the dog being pure is Imam Malik's opinion.

the opinion of Imam Malik (Rahimullah) and Ikrimah (Rahimullah) went against the jahmur of the other schools, their argument was based on the quranic verse,

فَكُلُواْ مِمَّا أَمْسَكْنَ عَلَيْكُمْ وَاذْكُرُواْ اسْمَ اللّهِ عَلَيْهِ وَاتَّقُواْ اللّهَ إِنَّ اللّهَ سَرِيعُ الْحِسَابِ

(Say: lawful unto you are (all) things good and pure: and what ye have taught your trained hunting animals (to catch) in the manner directed to you by Allah) ”eat what they catch for you, but pronounce the name of Allah over it: and fear Allah; for Allah is swift in taking account.” (5:4)

Also Imam Malik is quoted extensively in the Mudawwanah regarding the purity of the dog (see volume 1)

Now the Qadi Ibn Rushd (Rahimullah) does offer a dissenting opinion and states that perhaps Malik himself was not aware of the hadiths (dogs being najis) but even if that was the case Malik would still stick with his opinion because he would follow the book of Allah since its meaning was apparent.

As for keeping dogs as pets, I have heard that many fuqaha have allowed it based on the numerous sharh of Imam al-Qayrawaani’s Risala.

Just thought I'd provide the full hadeeth brother abdulwahhab was mentioning.

Sahih Muslim, Book 024, Number 5246:

A'isha reported that Gabriel (peace be upon him) made a promise with Allah's Messenger (may peace be upon him) to come at a definite hour; that hour came but he did not visit him. And there was in his hand (in the hand of Allah's Apostle) a staff. He threw it from his hand and said: Never has Allah or His messengers (angels) ever broken their promise. Then he cast a glance (and by chance) found a puppy under his cot and said: 'A'isha, when did this dog enter here? She said: BY Allah, I don't know He then commanded and it was turned out. Then Gabriel came and Allah's Messenger (may peace be upon him) said to him: You promised me and I waited for you. but you did not come, whereupon he said: It was the dog in your house which prevented me (to come), for we (angels) do not enter a house in which there is a dog or a picture.

Sahih Muslim, Book 024, Number 5249:

Abu Talha reported Allah's Apostle (may peace be upon him) having said: Angels do not enter a house in which there is a dog or a picture.

I read the whole thread but didn't find any definitive answer to the question, "Is one allowed to keep a dog as a pet in the Maliki madhhab"?

If the answer is yes, can a Hanafi follow the Maliki position in this regard?
