Default Payday loans
I did something very stupid in 2007. I got in a tight and went to a place that is essentially a payday loan place, but I feel their contracts operate right within the fringe of the law.

Summary:
1. I borrowed 200 in 2007 and wrote them a post-dated check.
2. To pay off the loan it would have cost $287.00.
3. I never had the 287.00, so I would go in, and essentially pay the interest on the loan - 111.00 and some odd cents. They in turn would hand me a check for 200.00 made out to me, which I would sign and hand right back over to them, along with the 111.00 in CASH ONLY.
4. This rocked on for a year, and when I realized I had paid them over 1200.00 I decided I was not going to pay anymore.
5. Today I got this voicemail to call this investigative company, so I did. This obnoxious windbag got on the phone screaming my social security number - i.e. is that your number, he was screaming so loud, he could not hear my answer, yes. Then he says he is going to file with the magistrate and get me charged with writing bad checks. He is hollering and screaming so loud, I just hang up after he told me his address and to be in there by 4:00 o'clock today with 287.18.
6. I google payday lending in my state, it is against the law. But again, I can't find the damn contract, I feel they are operating just within the boundaries of the law. I get a phone number to the state and the guy calls me back, says payday lending is illegal.
7. The kicker is, I have 300.00 bounce protection on my checking account. I don't think they have even put the check in because it is over a year old. So how can I be charged with writing bad checks when I don't think they have even tried to put the check through?
8. I want to shut these fuckers down. I would rather pay a lawyer double what I owe them.
9. Windbag referenced under #5 threatens me, You can pay me or you can pay Sentinel probation 700. Off topic, but I was arrested legitimately in 1996 and was on unsupervised probation for a year. I had to pay a fine of 100.00 a month, do community service, etc. The last day I went in there to pay the last of the money, this caseworker says, no now you need to do this and that, pay this much more, I said no, you don't understand, I have never been charged with this offense in my life. She says, you are wrong you still have to do this and this and pay this and that. I say okay. I go across the street to the superior court and get a freaking notorized blue-backed copy of my original court order. I walk back to probation office, they tell caseworker someone is there to see her. She opens up the door and sees me standing there with legal document in my hand and she says, "Oh, I must have made a mistake". Point being, they were going to take even more money and had I not had the wearwithal and knowledge to walk across the street and get a copy of my court order.
10. Back to #7 -how can I be supoened for writing bad checks when I don't think they have ever put the check through.
11. In summary, refer back to #8.

Go to your bank or have them send you a copy of your acct listing any checks that have been cashed. See if that one has been cashed. If not, then I don't think they have a case and are using scare tactics to get you to pay more. If it has or hasn't, and they are still threatening you, take any and all data concerning the transaction to a lawyer and let him deal with it...I would also contact the better business bureau......Stir that turd they keep flauntin' at you.....In fact, you might want to contact them before getting an atty. Could be you wouldn't need one once they get wind of it.... Worth a shot.....

If it's been cashed the bank statement would say how much it was, where it was cashed and who cashed it...

I think they have their butts covered with this business of me signing 6-7 papers real fast, they call in "flipping the loan" or something like that. So if we go to court, it will look like they have lent me over 2K but then why are they in possession of the checks made out to me? It was a stupid thing to do. I had to have the money that day, but I could have just gone to my ATM and gotten up to 300.00 and then just paid my bank back the 300.00 plus 35.00 in overdraft fees when I got paid that Thursday.

They prob are just legit enough to have their butts covered because if they are within the confines of the law, a judge has to follow the law.

I called my bank about this a while back. They said they would not honor a check over a year old - so I just don't see how they can sue me for bad checks when they haven't even tried to put it through - because they know they can't put through a check that old.

I am more pissed off about the way this guy talked to me, like Sgt. Carter from Gomer Pyle yelling and screaming, I can't stand that kind of behavior, would rather just be slapped in the face. I can't stand screaming and yelling.

Check them out. Contact the BBB. Maybe they can do something. Maybe not. If they can't or won't do anything then get an atty.....The whole thing smells pretty fishy to me.....

In my state a check over 6 months old that hasn't been presented for payment is void. Not worth the paper it's printed on. Now, your contract may be something else.

Same here in Cali........ Six months it is toilet paper..

I have been through a similar sitch here many years ago but I was fortunately able to pay it off way early & avoid that...

Here & I assume there they have clinics & non for profits that deal w/ these kinda robbers...........

They are usually working many ppl so you are not alone...

Have you checked into any of those??

I watch Dave Ramsey on a business program and the advice he gives people who call in with similiar horrible experiences is chalk it off to one of those lessons of life and make sure you don't make the same mistake again. I learned one of those lessons myself many years ago. My wife and I stopped in at a carnival and I got hooked into one of these "carney" game scams and I lost about $300.00. This was back in the late 60s and that was a lot of money. Sometimes the school of hard knocks is the best place to learn.

Call their bluff.

It is not a criminal matter but a civil matter.

You did not write a bad check as the company accepted it knowing you would pay it later.

You followed their rules and you paid them 6 times what they loaned you.

The other checks were not run through their bank so tey can't prove you received the money.

Tell them to do their worst and let a court handle it.

Like that you can ask for copies of everything they have including the contract and if it is true that it is not legal in your state to do this, they willnot want to go to court.

Just see what they say.

I think 600% profit is a prety good return and I can't see a court awarding any more above that.

Never be intimidated by a loud speaker. He was yelling because he had nothing to say.
