Default EFF Files Evidence in Motion to Stop AT&T's Dragnet
The evidence that we are filing supports our claim that AT&T is diverting Internet traffic into the hands of the NSA wholesale, in violation of federal wiretapping laws and the Fourth Amendment," said EFF Staff Attorney Kevin Bankston. "More than just threatening individuals' privacy, AT&T's apparent choice to give the government secret, direct access to millions of ordinary Americans' Internet communications is a threat to the Constitution itself. We are asking the Court to put a stop to it now.

I'm not sure this is a constitutional thing.
You give up your rights to privacy on the internet whenever you use it based on your isp's terms of service.

Plus If voice over lan is their target then I don't think that is wire-tapping because it technically isn't a telco system.

AT&T is a company & they have the legal right to do with whatever they want to the data that flows accross their equiptment I think.

you can't tell me they don't keep traffic logs themselves to sell to other companies.

It does get a little fuzzy if AT&T isn't your ISP. But then there are probably terms with those they lease bandwidth to also.

Now, if it were those bastiches in the RIAA then I say string them up by their toe-nails.
