Default Familygate: Malik Riaz submits unconditional apology in SC
Islamabad - The real estate tycoon Malik Riaz has submitted his reply and unconditional apology in the court in the contempt case against him.
In his reply, he requested the court to grant him unconditional apology, if court deems that he became hurdle in dispensation of justice.
On Wednesday, three member bench comprising Justice Mian Shakir Ullah Jan, Justice Athar Saeed and Justice Ijaz Afzal resumed the hearing of the case.
During the hearing, Dr Abdul Basit, counsel of Malik Riaz said that action on contempt of court against his client was the violation of Supreme Court Rules 1980 as the case against Malik Riaz was not correct.
He said the personality of chief justice was involved in the case so neither he nor his nominated bench could hear the case.
“Arsalan Iftikhar and Supreme Court registrar should also submit their affidavits. I as a lawyer in the case has full right to carry out cross-questioning from Arsalan Iftikhar and SC registrar in the court”, Dr Basit added in his arguments.
The senior lawyer said his client did not commit any crime; he only addressed a press conference, which was the voice of a merciful person who was being blackmailed.
He said that Malik Riaz did not blame chief justice but he talked about his son in the press conference.
He added that, according to rules and regulations, attorney general was supposed to initiate the contempt case but, in this particular case, Supreme Court registrar commenced the proceedings and even attorney general was not called in the case, which was wrong.
He said that SC registrar was not judge of the apex court and he had no authority to take action.
When Justice Shakir Ullah Jan said that what was new thing in the reply, Dr Basit said that although his client had submitted the reply on court orders but as a lawyer he (Dr Basit ) thinks that the case was not correct right from the beginning as SC should follow its own rules.
Justice Shakir asked him that he used the world “false” in his reply, which means liar. The court can take this as SC is liar. On which Dr Basit requested that word “false” may be replaced with “wrong”.
