I just drafted a pre-nup for someone that had a "cheater's clause" in it. She was to receive a certain amount of money depending on the length of the marriage, but it was increased dramatically if he was caught cheating.

I represented the wife and told her I didn't know if it would hold up in court or not, but she insisted on having it in there.
