[COLOR="Navy"]I disagree. The driver of the truck was ticketed because, well, they hit someone! You should always pay attention because pedestrians like to pop up everywhere. However, if this man had not been jaywalking this accident would have been avoided.

The jaywalking directly caused the accident. The "recklessness" is not what I think you picture where you hear that. From what I understand, they weren't drunk and swerving, thats not what it meant. It just means they hit a person because they weren't paying close attention. Yes, their bad for sure, but it happens all the time. By chance (or some astrological force!) another law was being broken at the same time and this happened. There is nothing to indicate that the driver would have committed a worse accident later, like you suggest.
Considering the bus driver pushed a couple of old ladies out of the way of the truck, yes he can say that the accident would have been much worse. As in running down a pair of old ladies worse. No one said squat about the accident happening later. I guess next time he should just stay on his bus and let the old ladies get run over.
