August 24, 2007 -- Brooke Astor's embattled son, Anthony Marshall, has decided not to enter a controversial -- and possibly forged -- amendment to his mother's will into probate, according to court documents.

A third codicil ordered that her properties, valued at more than $40 million, be sold, and the proceeds added to her residuary estate.

A handwriting expert declared last year that Astor's signature had been forged.

Now Marshall doesn't want to offer the codicil into probate, according to an affidavit he filed with the Surrogate's Court in Westchester, where a bitter contest for Astor's $130 million estate is unfolding.

A source close to the proceedings said taxes had nothing to do with the sudden change of heart - and that Marshall is likely dropping it to avoid controversy over the suspicious signature.

In addition, the purpose of the third codicil was likely a way to increase the hefty commission fees entitled to the executors of the estate - Marshall, his wife, Charlene, and a lawyer named Francis Morrissey Jr.

But both Marshalls were prohibited from acting as executors of the estate by a Manhattan surrogate judge last year after Marshall's son, Philip, accused his dad of neglecting Astor while living large off her estate.

So the purpose of the third codicil - to make all three richer - no longer succeeds, said the source.
