You are using an arbitrary project as an example. The law is not arbitrary. It applies to everyone. As much as we might support a particular project, it places the "absolute ownership" of any property in question. In effect, we are allowing the state to decide what happens with property everywhere and whether it is in its interest to seize it. The interest of state and citizenry is not always mutual. I do believe that in your argument as well as BKMONKEY's you two are lining up as the NIMBYs. You agree with this ruling as long as they aren't coming to seize and bulldoze your homes. That's a NIMBY position.
