i see mixed feelings online about wether this is a real program or not.

I checked it out, seems legit. Check out this review too: http://www.detectingadwarespyware.com/adwarealert/

Perhaps the malware and the program just share the same name????

EDIT: I take it back. There are numerous other sites that lambast that POS.

Well I've never had that before, but NOD refuses me access to the site.

ESET NOD32 Antivirus - Alert
Access denied !

I wouldnt touch it then!

Well, one must define spyware before trying to diagnose that argument. If one takes a simple tracking cookie as spyware, then the claim is true, albeit scaremongering because of commercial reasons. They'd want to sell those anti ad ware products after all.
