Whoever rules by other than what Allah revealed is a kafir? is this the kufr of apost
 

And whoever does not judge by what Allah has revealed - then it is those who are the disbelievers. (Quran 5:44)

I read that Ibn Abbas (ra) said this is not the kufr which makes one an apostate.

But fatwa no. 974 on islamqa says "Ibn ‘Abbaas said: “Whoever rejects what Allaah has revealed is a kaafir.”"

Regarding a question about this verse. Can someone tell me what is the opinion of the ulema on this issue. Are the Muslim governments that have secular laws instead of sharia laws apostates?
