The short answer to your question is no, unless he/she openly preaches anti-Islamic propaganda. If you wonder the wisdom behind the punishment for an apostasy within Muslim lands ruled with true Sharia laws you might have a glance at this. Please note that today there isn't any true Islamic state. "Also, Islam cannot be compared with other religions; if a Muslim abandons Islam and gives up his religion, he will not accept any other prophet; indeed, he will not acknowledge Almighty God either nor probably recognize anything sacred. He will have no conscience that will allow him moral and spiritual attainment; it will be corrupted. Therefore, in the view of Islam, in wartime, an unbeliever has the right to life. His life is protected according to Islam if he is outside the country and makes peace, or if he is inside the country and pays the head-tax. But an apostate does not have the right to life. For his conscience is corrupted and he becomes like poison in the life of society. But a Christian may still contribute to society, even if he is irreligious. He may accept some sacred matters and may believe in some of the prophets, and may assent to Almighty God in some respects." If thus foolishly blindly imitating and crushed under foot, their bonds with religion are broken, those irreligious people will become as harmful for social life as fatal poison. For the apostate’s conscience is completely corrupted and he becomes like poison in the life of society. It is because of this that according to the science of the principles of religion, “The apostate forfeits the right to life, whereas if an unbeliever is a member of the protected minorities or he makes peace, he has the right to life;” this is a principle of the Shari‘a. Furthermore, according to the Hanafi school, the testimony of an unbeliever is acceptable, whereas the testimony of someone who has strayed from the path of the Shari‘a is rejected. i want to ask question about a burning issue these days, about aspotasy in Islam. Please mention the Quranic Ayaat and Ahadees about the punishment of apostasy. Some people said that punishment of apostasy is not death. they said that if muslims kill the one who left Islam, then christian/hindus may kill their people who want to embrace Islam. they said that in Quran Allah has said "there is no compulsion in Deen-e-Islam.". please mention the practices of Sahaba(rta) about this issue Answer Al-Irtidaad (to renegade from Islam) The religion of Islam is the most perfect and complete religion. The laws of Islam are flawlessly designed by Allah. These laws of Islam are for the benefit and of mankind. Islam induces unity and always condemns division and sects. Once a person accepts Islam, he sees its beauty and perfection. If after seeing the beauty of Islam, a Muslim turns away from it, it means he turned away from perfection towards imperfection, disassociating himself from the unity of the Muslims ummah towards a way that is unacceptable by Allah. Allah always wishes good for His servants. By one accepting Islam, he will be Insha Allah entitled to paradise. However, after accepting Islam, one turns renegade, it means he has become entitled to Jahannam (Hell). This is not what Allah wishes for His servants. To prevent more people from becoming true candidates of the fire of Hell, Allah legislated a deterrent for it, i.e. the law of execution. This law of executing the renegade is a unanimously accepted rule according to all Muslims. Al-Hadith Sayyiduna Ibn Abbaas radhi allahu anhuma says: Nabi sallalahu alayhi wasallam said "Execute the one who renegades from his Deen." (Sahih al-Bukhariy Hadith6299, Sunan al-Nasaa’iy Hadith4059 edited by Shaikh Abdul Fattah Abu Ghuddah) Sayyiduna ‘Uthmaan radhiyallahu anhu narrates hearing Nabi Sallallahu alayhi wa sallam as saying "……The one who changes his religion after accepting Islam must be executed." (Sunan al-Nasaa’iy Hadith4057 edited by Shaikh Abdul Fattah Abu Ghuddah) Sayyiduna Abdullah radhiallahu anhu narrates Nabi Sallallahu alayhi wa sallam as saying "It is not Halaal to kill a Muslim except for 3 reason: …no.3.The one that turns away from his Deen, thereby disassociating himself from the group of Muslims."(Sahih Muslim Hadith4351 edited by Shaikh Khalil ma’moon Sheeha) Ijma’ The one who renegades from Islam must be executed is the unanimous verdict of the sahaaba, none of them rejected it. The unanimity of the Sahaaba on an issue is conclusive evidence of the same. The Fuqaha (Jurists) All the 4 Mazhabs are unanimous that a renegade must be executed if he does not revert to Islam. Hereunder are classical texts from each of the 4 Mazhabs: Al-Hanafiyyah Imam al-Marghinaaniy says: "If a Muslim, may Allah forbid turns away from Islam, the religion of Islam should be presented to him. If he has any doubts they should be cleared…and he should be kept under supervision for 3 days. If he reverts to Islam, he must be set free, otherwise he should be executed. (Al-Hidaya) Allamah Ibn ‘Aabideen says: "Note well! It is unanimous that a renegade from Islam must be executed" (Rasaa’il Ibn Aabideen) Al-Maalikiyyah Imam Maalik says: "The one who renegades from Islam to another religion and exposes it will be asked to repent from his action. If he does not repent, he must be executed." (Al-Mu’atta lil Imam Maalik) Al-shaafi’iyyah Imam al-Shaafi’iy says: "One who renegades from Islam will not be left alone, either he reverts to Islam or he will be executed." (Kitab al-Umm) Al-Hanaabilah Allamah Ibn Qudaama al-Hanbaliy says: "All the scholars are unanimous that a renegade must be executed." (Al-Mughniy with Sharh al-Kabir Vol.10 Pg.74 Dar al-Kutub al-Ilmiyyah Beirut) From the above it is explicitly clear that there is no leeway in the religion of Islam regarding executing a renegade from Islam. and Allah Ta'ala Knows Best Mufti Ebrahim Desai |

Br xs11ax, ![]() actually it was a reply to your post :P the fatwa does not make a distinction between those who become apostates while living in the muslim lands or those who become apostates while living in a non-muslim land and later returning to the muslim lands as an apostate. if there IS a distinction between the two then please post an explanation for my benefit..... ![]() no doubt there will be some non-muslims reading this in horror......so i would just like to say that the muslim ummah is not the only nation that gives the death penalty to those who defect from their nation. in times of war defectors from one nation to the enemy nation are executed and so are people who commit treason. an apostate from islam is defecting from the muslim nation to the non muslim nation which is also regarded as treason. so before judging islam on this point first judge the laws of your own country! |

the fatwa does not make a distinction between those who become apostates while living in the muslim lands or those who become apostates while living in a non-muslim land and later returning to the muslim lands as an apostate. But the specific point here is; is there a Darul Islam outside some parts of Afghanistan and Somalia? So unless the interest of the OT is related to coming back to countries as Afghanistan or Saudi or a few others, I don't see the actual relevance of the problematic. Rather, if the concerned people is you, why don't you come back to Islam? |

Well umar, yes it is me, my wife want to do hajj but i fear that the barbaric law of islam might take my life. So i need to know the specific verdict on it. If u see all of my thread in this forum, i do not argue with any one, i try to find the information. Arguing with fan of Hitler is useless, he will never see the bad side of Hitler ever. So when u ask me about my personal matter in two of my post, i took the choice to let you know. I left islam five years ago. The girl i love is a muslim and i told her that her marriage with me according to islamic believe is nullified. So u can stay with me on mutual trust and on a relation based on love and care for each other. She choose it, recently she want to do hajj, so i need to know the law of shariah. And if u ask me what is my educational level on islam, i can tell u that it is not much but it is also not less, i memorized the complete quran so i know quran by heart. then i have taken ifta course, i don know what u call it, people who finish studying ifta can give fatwa. I have twisted many fatwa here in my country to save many peoples life in many ways. I knew what is the verdict on this matter, there are many ways to look on it. But any way, now i can show my wife that yes my life will be on threat if i go these countries. I told her to go with his father or wait until my child become adult. I gave my family the freedom of believe, but i try to teach them to accept thing which is possible to verify.

You know Quran by heart, you can give fatwa and yet you don't know the sharia law of apostasy? Lets not engage in ANY type of discussion on the topic until we know the person is legitimate. then i have taken ifta course, i don know what u call it, people who finish studying ifta can give fatwa. |

mmb786, the reaction you are showing is normal to me, you did not faced this kind of situation i believe before in your life. When i was muslim i had the same hatred for murtad and kafir, now i do not have it. That's the beauty of not believe in any dogma. Let read again what i wrote. I told my wife the verdict. But she wants to check it from other. There are different kind of answer to that. See what umar said before my comment in his first line. He dose not agree with xs11as. If it were Cristal clear, then he would not said that. I believe he is more liberal thinker then xs11as, that's why he choose to see it differently. Also i need to tell u that in a democratic society, we prefer to say our opinion on laws and regulation in a country. I'm not attacking any person, I'm attacking on a law made by human, so it is okey to tell barbaric if a law is truly a barbaric one. If u go a country where eating ice cream is punishable by cutting the penis, will you not say it barbaric? but for those who are fan of that law can bring the logic that ice cream make people fat, make tonsil and do lot of harm. It is very hard to make them realize that their law is barbaric. and 786 is not bismillah.
Any way, keep the light away from me, talk about what I've ask for. See if you find a solution for very specific question whether or not a non citizen should be given the punishment for apostasy. I'll try not to talk about my personal matter again. Hope you will go to the discussion. |

![]() Abu ‘Umar al-Saif, may Allâh accept him, said: “There is no significance in memorizing texts or studying knowledge, rather the important thing for knowledge to be beneficial is purity and piety of the one receiving the knowledge. If the heart is pure, then knowledge is beneficial and, Allâh permitting, Muslims will benefit from this knowledge. “But if the heart receiving this knowledge is hypocritical or sick then its owner will perforce suppress the truth, slander Allâh with lies and dissuade (people) from the cause of Allâh. His words and fatwas become a cover for lackey governments to cover their crimes against Islam and the Muslims.” Ibn Qayyim, may Allâh have mercy on him, said: All among the people of knowledge who prefer and desire the world must undoubtedly speak untruths about Allâh in their fatwas and judgments , in their decisions and edicts. Because the judgments of the Lord Almighty often are at odds with the desires of the people, especially those in power. Those who follow their longings cannot attain their desires except by often violating and repudiating the truth. The scholar or the ruler who loves power and follows his desires will not achieve either except by resisting the truth that opposes him, especially if a shubhah (doubtful area) was established for him. The shubhah and the desire will be in agreement and passion will be stirred up. What is proper will be hidden and the face of truth will be obliterated. If the truth is obvious and there is no hiding it and no ambiguity about it, he purposely violates it, saying: “I have a way out through repentance.” About them and those like them, the Almighty said, {Then, there has succeeded them a posterity who have given up As-Salât (the prayers) [ie. made their Salât (prayers) to be lost, either by not offering them or by not offering them perfectly or by not offering them in their proper fixed times] and have followed lusts...} [Sűrah19. Maryam (Mary) Ayât. 59 For someone to claim to be an authority ( ie. memorize Quran, study ifta course, etc) and to be apostate signifies the desire to have power over others for his own sick pleasure. |
