Fanatical adherence to Hanafi Madhab:

I produced this article long ago with a mini translation and since then had numerous conversations with Mufti Hussain Kadodia (HA) & Maulana Abu Hajira (HA) about the matter in public and in private.

And due to discussions with Ulama, I have gone from a supporter of this to somewhat of a sceptic and I see the point of South African Ulama on this one!

It is true that fanatical adherence to anything other than the Qur’aan & Sunnah is blameworthy and an exaggeration but we have to look at the situation on the ground. This article calls for Ulama (& Muftees) to look at all Madhabs and issue rulings which bring “ease” to the masses rather than sticking to one Madhab.

A fine principle indeed and also backed by Shaykh (Maulana) Ashraf Ali Thanwi (RA) in matters other then Ibaadat as explained in this talk by Shaykh (Mufti) Taqi Usmani (HA):

Fact of the matter is that many Ulama (& Muftees) amongst the Deobandees are not aware of the rulings of other Madhabs as they are not taught this as part of their curriculum and they don’t study it after graduation. We cannot expect this from overwhelming majority of our Ulama (& Muftees), they are taught Hanafi Fiqh and trained to give Fatwa in Hanafi Fiqh so they are restricted. When venturing out in other Madhahib they usually rely upon books like “Al-Fiqh 'ala al-Madhahib al-Arba'ah” as you can see that in the bookshelves and libraries of most Ulama and I am not sure if it lists the most sound opinion of each Madhab as I found out yesterday and made known to a well known Hanafi Deobandi Mufti (in UK).

The respected Shaykh (Mufti) is also fond of quoting Imam Shaf'ae (RA) thinking that it is the sound opinion of Shaf'ae Madhab which is obviously not the case. His Fatwaas are quoted by other Ulama (students etc.) so the error perpetuates.

So the choices are for our Ulama are:

  1. To stick to Hanafi Madhab in which they are taught and trained
  2. OR turn to 1 or 2 works on other Madahib and stumble their way to a Fatwa.


Which one do you prefer?

For the vast majority of Ulama (from our institues, today) the suggestion in this article and the advice of Shaykh (Maulana) Asharf Ali Thanwi (RA) isn’t possible!

It can be possible with co-operation between Ulama i.e. Deobandi Hanafi Muftees to rely on Shaf’ae Muftees such as the likes of Shaykh (Mufti) Taha Karaan (HA) & others and quoting his Fataawa instead of trying to discover the Shaf’ae Madhab and the same strategy can be applied with Shaykh Abdul-Shakur Brooks (HA) for Maliki Fiqh rather trying to discover the Maliki Madhab.

Good idea but how do you implement this?

I’ve noticed that in issues pertaining to the broader ummah this method has been adopted. For example in Islamic Finance, Muslim Personal Law and Halaal consumables.
