What's funny is when I did a search for the quote...I came up with a whole mess of various forum and facebook posts where people used the exact quote, claiming it was someone THEY knew.

This is one of those urban legends that gets passed from person to person, and everyone who repeats it claims it was someone they knew...JUST to make it seem like they have something interesting to talk about.

I don't know if its on record anywhere anymore because this was long before the internet was so popular...maybe early 90's, but years ago I was a Reader's Digest junkie and there was a story about us being a lawsuit happy society and how ridiculous its become. The feature included a story about an elderly New York woman who owned a Toy Poodle. While she was away a young man broke into her home via the fire escape and was bitten in the calf by her dog. He was criminally prosecuted as a neighbor called the police and he was caught mid-robbery. He sued her FROM JAIL for the dog bite, claiming psychological trauma and medical bills. She counter sued for psychological trauma and the costs of repairs from the break in. He won. She appealed and he won the appeal.

I wouldn't say a lawsuit of this type is very common, but its happened. Still a civil matter and nothing that would endanger the life if the dog, though.

I know in Ontario, any pit bull type dog (or any dog that looks 'substantially similar') that bites a person or another animal, whether provoked or not, automatically gets a date with the needle.

So if a loose dog attacked me, or my house was broken into, or I was assaulted by a rapist... and my dog tried to protect me... he'd be put down. http://www.pitbull-chat.com/images/smilies/no2.gif And yet you can legally own a tiger in this province.

I am curious...
 
If I was walking my dog or just sitting at home and someone was to attack me and my dog was protecting me and bit the person....Would they still take my dog away from me? Or write her off as an aggressive dog? Wasn't sure if anyone had a clue about that kind of stuff...

Really it depends on where you live and what the Animal Control laws are there pertaining to dogs and the like.
If your dog is likely to bite someone though, you should be very careful regardless of the laws where you live.
Is she aggressive?

Not in the least bit, she doesn't growl or bark or even have a aggressive stance with people (she is very submissive but not scared). But she is however very protective of me, so I am unsure on if she would ever do something to keep me from getting hurt

Most aggressive dog and dog attack laws specify "unprovoked aggression", so if you were being attacked, or your home broken into, likely you'd be okay.

But...it will come down to a he-said-she said in some cases.

Also, someone may attempt to sue you in civil court even if it was determined in "real" court that you are not at fault.

I am sure she would, most dogs will at least try to defend their owner in a time of need, regardless of breed or temperament.
I would check with the laws in your area though, it's just good information to know.

well, considering that by todays laws and standards, if a person breaks in to your home and hurts themselves in the process they canm sue you, so i would say that more than likely yes, they would take your dog and you would have a lawsuit by the person who attacked you. yep i know i know, its fucked up. but thats just proves the stupidity of and total bitchification of modern society

Depends on the person bit. if they reported the bite and it was severe enough to cause damage you maybe in a world of hate with a Dangerous dog ordinance, a costly medical bill and the chance of your dog being euth. BUT imo, someone breaking in vs someone being on the streets are two diffrent senerio's and should be viewed as such and while I believe you would get off the hook, MAYBE in a break in vs public I wouldn't take that chance..period.

A person was breaking into somebody's house and fell onto their kitchen counter, which of course had knives on it.

The person who was trespassing sued, and won.

My thoughts exactly.
I remember a story where a burgler broke into a yard to get into a house and when he got bit by the dog out back he sued because there were no signs up saying the people had a dog.. he won.
I always assume that no matter what my dog will be the one held at fault for anything whether its his fault or not or whether he was provoked or not and I just try and keep him out of a situation that could potentially result in me loosing him.

But if someone breaks into my home I dont know how I am supposed to keep her out of a bad situation, she sleeps in my bed with me I dont like putting her in a pin
