The treatment Pollard received in a prision hospital for the criminally insane sounds like something from the Soviet Gulag.

Former Indiana Congressman Lee Hamilton, who Israeli agent Jonathan Pollard credits with saving his life, rejoined the effort to persuade US President Barack Obama to commute his life sentence on Tuesday.

Following Pollard's sentencing in 1987, he was sent to a Springfield, Missouri, prison hospital for the criminally insane. Pollard's wife Esther said that at that facility he was kept in what she described as "inhumane conditions," isolated and naked, without blankets, sheets, or his glasses in sub-zero temperatures for more than a year.

"Periodically, a blanket would be thrown over him to cover his nakedness and he would be led out to meet FBI interrogators who showed him lists of prominent American Jews," Esther Pollard said. "They told him that if he wanted to get out of this place, he would have to finger names on the list as his co-conspirators. Of course, Jonathan refused." She said Pollard's nightmare went on until his parents contacted Hamilton, who was their congressman. Hamilton intervened and began asking very embarrassing questions about why Pollard was being held in a prison hospital for the criminally insane. The government readily admitted that he was not a patient and that he was not there for treatment…

"It was because of Hamilton's intervention that Jonathan was transferred out of what he still refers to as a scene from Dante's Inferno," Esther Pollard said. "Were it not for Lee Hamilton's principled intervention years ago to pull Jonathan out of a situation of unwarranted severe affliction -- cruel and inhumane punishment -- it is not certain that Jonathan would still be alive today. We will always be grateful to him."

Hamilton, who served in Congress for 34 years, currently serves as an honorary co-chairman for the World Justice Project, which works to lead a global, multidisciplinary effort to strengthen the rule of law. He is also a member of Obama's Homeland Security Advisory Council and his Foreign Intelligence Advisory Board, which give him direct access to Obama

"I do not underestimate the gravity of Mr. Pollard's crime, but I do believe that he has served a disproportionately severe sentence and that he should be promptly released," Hamilton wrote. source: http://www.jpost.com/International/A...aspx?id=210370

As the case of Jonathan Pollard winds its way through the appeals courts, it is becoming increasingly clear that at the bottom the outstanding issues are political. Not that we'd want to belittle the relevance of the work of
Pollard's lawyers or of the further appeal that may be made to the highest bench. But as the case has been winnowed by last week's opinions from the U.S. Court of Appeals for the District of Columbia Circuit, it becomes clear that if any mistakes were made, they were not made by the judge who took Pollard's guilty plea and meted out his life sentence. There had been suggestions that the sentencing judge, Aubrey Robinson, was compromised because he had allegedly received out-of-channels information about the material Pollard sent to Israel. Supposedly the judge learned that some of the secrets Pollard passed to Israel referred to Israel's dealings with South Africa. Judge Robinson, as a black man, might have been particularly sensitive to such evidence. Such was the opinion of Arthur Goldberg, who talked with Judge Robinson, according to an affidavit of Alan Dershowitz. But this affidavit was not even credited by the one judge who sided with Pollard on appeal, Stephen Williams.

What Judge Williams does credit, in a noteworthy dissent, is the argument that the federal prosecutor violated the spirit, and on one key point even the letter, of the deal under which he got Pollard to give up his right to a trial and to plead guilty.

Secretary of Defense Caspar Weinberger signed court papers in 1987 that urged a stiff sentence for an American caught spying. "The magnitude of the treason committed," Mr. Weinberger wrote, was so serious that "no crime is more deserving of severe punishment." Guided by the defense secretary's statement that he could not "conceive of greater harm to national security," federal Judge Aubrey Robinson sentenced the spy to the maximum term - life imprisonment.

Three cheers for a judge tough on crime, but hold on. Mr. Weinberger's claim that Jonathan Pollard committed treason by spying for Israel was bad law or curious diplomacy. The capital offense of treason is one of the few crimes defined by the Constitution. "Treason against the U.S. shall consist only in levying war against them, or, in adhering to their enemies, giving them aid and comfort."

Israeli agent Jonathan Pollard did not do any damage to the United States by passing classified information to Israel, former US deputy attorney-general Philip B. Heymann wrote US President Barack Obama Wednesday in a request to commute Pollard's sentence.

Heymann is James Barr Ames Professor of Law at Harvard Law School, the author of two books on terrorism, and director of Harvard Law School's International Center for Criminal Justice. In his letter to Obama, he became the first US official to state that he has reviewed Pollard's complete record and found no evidence that helped America's enemies.

"Pollard's conviction was justified but his sentence was entirely out of line with others engaging in similar behavior and it was made less-than-legitimate by a treacherous recommendation of the then secretary of defense [Caspar Weinberger]," Heymann wrote. Since when is Biden calling the shots?

U.S. President Barack Obama was set to release Jonathan Pollard but his vice president thwarted the move, The New York Times has reported.

According to the report, Vice President Joe Biden met last week with 15 rabbis in Boca Raton, Florida, when he was asked by one of them why Pollard, who was convicted in 1986, was still in prison.

In response to the question Biden said, “President Obama was considering clemency, but I told him, ‘Over my dead body are we going to let him out before his time.’”

I think it more likely Biden is lying.

Evidence is growing that U.S. President Joseph Biden deliberately “took the hit” in a political move for his boss, President Barack Obama, last week over the painful issue of freedom for long-time imprisoned Israeli agent Jonathan Pollard. Obama's unwillingness to grant clemency to Pollard, long a sore point for the American Jewish community, was one that Israeli Prime Minister Binyamin Netanyahu officially raised publicly earlier this year...

In a 2007 interview with Shalom TV, Biden went on record to plainly state that he supported “leniency” for Pollard. As a result, last week's flip-flop is seen as an exercise in Democratic politics. The man who was dubbed "Obama's rabbi" by the New Yorki Times, wrote the following to the President recently: “Jonathan Pollard has served 25 years in prison for crimes for which he has since shown great remorse, publicly and privately,” Rabbi Funnye's letter said. “With great humility and familiarity with your feelings on matters of justice, I ask you to seriously consider a commutation of Jonathan Pollard's sentence.” source: http://www.israelnationalnews.com/News/News.aspx/142330

Kidnapped soldier Gilad Schalit's father Noam and a group of former Soviet prisoners of Zion joined a long list of public figures in Israel and the United States Sunday calling for US president Barack Obama to release Israeli agent Jonathan Pollard.

In his first public statement about Pollard, Schalit said that "he served his sentence and the time has come to free him." US President Barack Obama would commit a “miscarriage of justice” if he decides against commuting the sentence of Israeli agent Jonathan Pollard, said Bernard Nussbaum, former White House Counsel during President Bill Clinton’s term.

In a letter sent to Obama on Saturday, Nussbaum noted that he studied Pollard’s complete file “extensively,” and agreed with former US Attorney-General Philip Heymann – and a host of senior American officials – that Pollard must go free without further delay.

“I write this letter to state that I fully share the view expressed by Professor Heymann – as well as the other distinguished former public officials who have written to you – that the time has come for Jonathan Pollard’s sentence to be commuted,” Nussbaum wrote.

I will not repeat the cogent reasons set forth in Professor Heymann’s letter, except to say that I too believe that Jonathan Pollard has been appropriately punished for his conduct, and that a failure at this time to commute his sentence would not serve the course of justice; indeed, I respectfully believe, it would be a miscarriage of justice.

Nussbaum opposed pardoning Pollard when he was White House Counsel from 1993 to 1994.

My sincerest condolences to the Pollard family.

Israeli agent Jonathan Pollard's bid to see his father before he died ended tragically on Saturday morning when Morris Pollard, 95, died at Memorial Hospital and Health System in South Bend, Indiana.

Morris Pollard had been hospitalized for more than a week, suffering from the impact of a severe bladder infection. His rabbi at Temple Beth-El in South Bend, Eric Siroka, sent out a letter to his congregants informing them the funeral service would be held on Monday.

Pollard's family, American Jewish leaders and Knesset members had been lobbying for Jonathan to be granted what is called "compassionate leave" for 24 hours to allow him to see his father before he died. Jonathan spoke to Morris on the phone last weekend for the last time.

Former US Vice President Dan Quayle recently wrote President Barack Obama a letter, urging him to free Jonathan Pollard.

"I write this letter urging you to consider commuting the sentence of Jonathan Pollard," the former VP, who served under George Bush Sr., wrote. "I believe that a life sentence for the crime committed is very extreme. Though his crime was very serious, I hope you will once again look very carefully at this pending request."…

Recently, former Secretary of State George Shultz and ex-Attorney General Michael Mukasey also expressed their support for commuting Pollard's sentence. United States Senator John McCain said he supports the release of Jonathan Pollard, who has been in prison for 25 years for passing classified information to Israel. Pollard was sentenced to life in jail.

McCain expressed his support for Pollard's release during a phone call with Prime Minister Binyamin Netanyahu, on Thursday.

He joins a growing list of American public figures who have called for Pollard's release, among them former Secretary of State Henry Kissinger and former Vice President Dan Quayle. Advocates for the release of Israeli agent Jonathan Pollard redoubled their efforts this weekend to persuade US President Barack Obama to enable him to visit his visit his father on his deathbed .

Pollard received a call from his brother Harvey that their father Morris, 95, was hospitalized at Memorial Hospital and Health System in South Bend, Indiana, suffering from the impact of a severe bladder infection.
