Default Bail refusal to Kanimozhi unfair: MK
Frustrated by the delay in the grant of bail for daughter Kanimozhi in the 2G spectrum case, DMK president M Karunanidhi on Thursday expressed anguish that it appeared the courts were acting on “unsustainable assumptions and opinions” while delaying justice.

“In the light of opinions aired by legal luminaries and guidelines issued by the Supreme Court, a question has now arisen whether justice is delayed due to unsustainable assumptions”, the former chief minister said.

Writing in party organ Murasoli, a day after Kanimozhi’s bail appeal was adjourned to December 1 by the Delhi high court, he said, “If courts, one of the pillars of Indian democracy and last resort for the people of country, hesitated to provide legal rights and protect the basic foundations of the law, a question will rise in everyone’s mind where Indian democracy is going and about its future”. In any case, he hoped for the best when the high court took up the bail plea on December 1.

Quoting expert views, including those expressed by lawyers Ram Jethmalani, Aman Sethi and Raju Ramachandran,
and Congress general secretary Digvijay Singh, who criticised the courts for keeping Kanimozhi and others “in continued incarceration”, Mr.Karunanidhi said, “Kanimozhi and others have been languishing in jail for over six months.

The investigation agency, the CBI said it had no objection for granting them bail. Supreme Court had directed the accused to approach the trial court after the framing of The DMK president quoted Mr Jethmalani alleging ‘grave miscarriage of justice and a deliberate misapplication of law’ by the trial court.

“Bail is refused in cases where the accused is likely to abscond, tamper with evidence or influence witnesses. There is no such evidence at least in the case of this woman, Kanimozhi,” the former law minister had said.
