Default Was Thurgood Marshall a villain?
Why did you make this poll anonymous, Mr. Fun?

The answer must be obvious to anyone but old crackers who want their apartheid back.

I don't know his actual record as Supreme Judge, but SCOTUS is largely a political institution, there's no way around that. So, it's only natural that Conservatives call Democratic juedges "activists" and vice versa.
Luckily, your fundamental principles are not totalitarian and perpetuated, so they need permanent adaptation to new developments.
And that was on purpose IMO, since otherwise you'd have had a perpetuation of more and more anachronistic norms and thinking, as is the problem with the exegesis of many religious texts

The whole attack Thurgood Marshall thing the Republicans are doing right now is just old fashioned dog whistle politics where the Republicans are trying to solidify the white racist vote for the coming election. It's not surprising they've chosen the 1st black supreme court justice (and the guy who successfully lead the case which ended segregation) as their target. As a bonus Kagen used to work for Thurgood Marshall so they can conveniently try to claim she hates whites just like Marshall supposedly did.

So what do you think?
That anyone who describes his judicial philosophy as doing what he thinks is right and letting the law catch up should never have been a judge.

Oh, for ****'s sake, Oerdin. That's not a bonus. That's the only reason Marshall has come up.

Niether Harriet nor Kagan has passed the bar.
Good lord, do you even read what you post? This took me precisely 12 seconds of googling:

[Miers] was admitted to the Texas bar in 1970 and admitted to the DC bar in 1997.

Good lord, do you even read what you post? This took me precisely 12 seconds of googling: Ah, forgive me for reading Daily Kos. I had forgotten that Meirs has passed the bar.

I took the New York State Bar examination in the summer of 1986 and passed. That's according to Kagan. Is there any independent confirmation?

Ahh, ok. I was mistaken. Sorry.

I know there was something new about her. She wasn't a judge on any court. I had thought it was that she wasn't a lawyer.

Now I know you're just an elaborate troll. Bravo!

Edit: fortunately your attempted DanS didn't achieve DanSness.

I'm a repug and from I've heard, I kind of like Kagan. The only negative is her total lack of any experience in courtrooms. But I don't think that it's that much of a negative.
She'll clearly be perfectly qualified, I disagree personally with her (probable) constitutional views but I'm not going to agree with any Obama nominee.

Yes, of course Obama nominated someone WHO COULDN'T PASS THE BAR.' There's been some discussion about it. There's no constitutional requirement that the supreme court appointee be a lawyer.

All I am arguing is that there are plenty of liberal judges with more experience on the bench than Kagan.

See my DanS:

Solomwi can corroborate that you didn't admit **** until editing about 8 minutes later. Your attempt to pretend otherwise now would be hilarious if it weren't so sad.
If memory serves, his first DanS eluded even you. What drew my response was something along the lines of "Kagan still hasn't passed the bar." Still, kudos to you, Ben, for the admission. That's one small step...

In spite of some minority race members who are Republicans, there still seems to be a streak of racism among some white Republicans. The smearing of a civil rights activist by some Republicans during Kagan's hearing substantiates this.

Sure, if bigotry is one's habitual first resort for an explanation of the actions of others. Marshall was a civil rights activist, but also a Supreme Court justice with a judicial philosophy many, especially on the right, find odious. I haven't had a chance to see or read what was said about Marshall, but given the context, i.e., public hearings on the nomination of his former clerk to the bench, I'd be surprised if the alleged smears were based on race, rather than that philosophy.
This. It only takes reading about a hundred SCOTUS opinions in which Marshall took part for a non-racial explanation to jump out at you.

Kagan shouldn't sit on the court because she is ugly.

In a fair and just world the only ugly people with power would be men.

I, and others, think it is wise and healthy to have a non-judge on the court. It was intentional. It took Nixon to go to China.

I know it's intentional. I think there would be better justices. If we use the same standard used for Alito and Roberts, Kagan is not as qualified.

If you can think of someone else you think Obama should have picked, name them. I can come up with 10, all who have served or are currently serving as judges.

Leah Ward Sears, if he has to have another woman.

Diane P Wood

Merrick Garland

Ruben Castillo

Carlos Moreno

Sidney Thomas

Anne Williams

Margaret Mckeon

Johnnie Rawlinson

Kim Wardlaw

All have more credentials and experience than Kagan.
