Uhhh, if you read the article:

The request creates a logistical challenge: Most Internet providers store data such as Web searches for 30 to 90 days. Storing such information significantly longer is more expensive, McClure and others say. So, they do store data but only for a couple of months. Two years is a long time to be saving this stuff. It's also not limited to searches. The DoJ also wants two years of e-mail traffic data to be stored.

It would be easy enough to save search records only for suspicious terms, and not ALL terms.
