Default Zzz... Samsung vs Apple saga continues
http://www.bbc.co.uk/news/technology-14652482

Now Apple wants to ban Galaxy phones in Europe due to the way Sammy displays photos on its phones [rolleyes]

Apple are pathetic.

I was about to link that too.

I think its about time the Patent system got a major overhaul because this is extremely pathetic, and allows Apple to go after pretty much any phone vendor, or pretty much any modern day touch screen device that holds a gallery..

Patent in question....

It might seem odd but it's actually good news for Samsung, all the design related stuff has been thrown out by the judge and this is basically the only thing that stuck. Of

Samsung have already stated they will replace the Gallery application and they have until mid October to do this, it's meaningless. [rofl]

On other forums people are saying the infringement is only due to the way pictures bounce back when you partially swipe a photo and it is specific to modifications that Samsung have done to the gallery app.

I've tried partially swiping on my Nexus and it simply moves on to the next picture so it could be Galaxy S specific and not Android specific.

Samsung are an update away from this problem disappearing. Apple on the other hand have invalidated one patent and destroyed their trade dress claims.

I can only compare my Desire HD, Samsung Galaxy Ace and my iPad as my missus is out so i cant try on her iPhone 4, but the feature you speak of does exist on my Desire HD just not to the same extend. If I swipe a piccy to view around 5-10% of the next image, it simply bounced back to the previous one, anymore and it switched. The Ace is about 20%.

My iPad on the other hand, its a good 51% before it bounces to the next image.

You could be right in that its a Galaxy S thing, as the Ace definatly isnt the same as my iPad.

Overall the Galaxy S II is about as close as you can get to the iPhone on Android. TouchWiz emulates iOS layout on the home screen quite a bit, even unlocking and locking the phone sounds similar to an iOS device. (Using Launcher Pro which I greatly prefer) Then you have the single home button at the center of the phone. I *do* wish they copied them on the silent switch so I don't have to tap twice and then hold the sleep button, then press the option on the screen to put the phone into silent.

Even the box the Galaxy S II comes in is a bigger and clunkier version of the iPhone packaging.

This is an interesting read: http://ieforum.nl/backoffice/uploads...20Samsung).pdf

It's the document from the case and cites plenty of cases of prior art with the trade dress claims. Things like the single home button were not unique to the iPhone for example.

Thing is everyone likes ergonomics and Apple have done well in that area, obviously. However it's like IBM our whoever first put the touchpad onto a laptop, then suddenly Apple does out and gets sued. Personality I dn't like Touchwiz either and use Zeam launcher.

Well the important thing is the judge didn't agree with you and cited examples of each of these design features being used previously which is why he through them all out.

Sure I was more commenting on how the looks, sounds, feel, packaging, even down to the icons on the screen are eerily similar to the iPhone on the Galaxy phones. When you look at just one thing, it is easy to give wiggle room but all those things combined, the similarities are quite strong. Unboxing the phone, I honestly felt like I was opening up a cheap iPhone knockoff.
