You would never pull out into on coming trafic or drive on the wrong side of the road, so why risk your childrens health in a manner simlar?
As for the driver why is he even responsible for a piece of machinery that could kill or main?

Such sad news, makes me so angry when people do **** like that with their kids.

Regarding how far away she was from the nearest crossing, that would not be classified as J walking in Australia.

However I have to agree with some people here. The mother was the stupid one, whether or not the guy was under the influence. The driver would have had a much more difficult time seeing the mother and child then the mother seeing the driver.

Unless you are blind it would be nearly impossible not to notice a cars headlights unless they were not turned on. However I myself have had cases where people have randomnly wondered across the road right in front of me and I couldn't see them until the last moment even with high beams on.

I really do feel sorry for the loss, but it was the mothers own stupidity. I would never cross a road with a child unless I thought it was 100% safe to do so.
