Default Speeding Ticket Redemption
A few weeks ago on Oct. 13 (Friday the 13) It was 8:30 at night and I was going to a friends house when I was wrongfully pulled over and issued a speeding ticking (73/55). At the time the cop was a **** and didn't listen to me that he got the wrong guy. And there was actually a guy speeding ahead of me. I went to court yesterday and plead not-guilty. I gave my side of the story and was really emotional and told them how upset I was over this situation. Told em I lost sleep over this for a week and that I never have a problem paying a fine for something I have actually done, but I am not gonna come in here and plead guilty or pre pay this fine for something I didn't do. I explained that I drive that road 30 times a week and see the cops there everyday and I could see the light reflecting of his cop car lights a mile away. And that he got the wrong car.

Also the cop was lying his ass off during his testimony and you could clearly hear it in his voice that he had no confidence in his story and even was making it up as he went along. He said he saw a silver Acura going at a high rate of speed, which is amazing that somehow he can see at night on an 3 lane interstate looking into the headlights of about 20 cars and sees me a sliver Acura? I mean I can't even believe it went on after he said that!

But the real reason I think I got off, besides that i was telling the truth, was that he put "Honda" as type of vehicle and I drive a Acura. When the Judge said that everything got dead quiet. Then the Judge said, "Lord I'm gonna give you the benefit of the doubt. Not guilty." I was like "thank you" and walked out I felt like I won the freaking lottery because I never thought I would really be able to beat that ticket because it was the cops word against mine. My only advice is if this happens to you just go in there and give em hell because you have nothing to lose.

The average speed on a frequently-patrolled 55mph highway is usually about 55-63mph. Anyone who says that a car was "going at a high rate of speed" about a car going 73/55 is lying through his teeth. Doesn't even matter that you didn't do it.

To be honestly seen as going much faster than traffic, you need to be doing 20mph over the average speed, or more.

Congrats on getting the ticket revoked.

P.S. What Acura do you drive?

I'm glad you got off but sorry but I think that's terrible advice. No matter if you are innocent and it's the cops word against yours you will loose 99 times out of 100. If the cop hadn't made a mistake you would have been found guilty. Once you are found guilty the penalty is much harsher.

Also in Australia the cop doesn't even have to show for court and they just go by the report they filed. [help]

That's not true, the penalty isn't harsher at all, at least here. I fought a wrong ticket 2 times and they never let me off the hook, but my fine was still the same as it was before fighting it.

Also in the states (well at least here in California), if the cop doesn't show up, the decision is automatically in your favor.

Yeah here the penalty doesn't get any worse if you lose.

Or you guys just have it bad. Making the penalty harsher if you lose seems like a deterrent to keep you from fighting it, whether you know you're in the right or not. Messed up huh?

Actually, if you plead guilty, they will usually drop the fine and points in half. If you go through trial and then get found guilty, you get stuck with the original citation.

yeah that's known as plea Bargaining [yes]

you normally get a lawyer to do that for you or if you get an NIP through the post with the option of court or plead guilty by post you tend to get a lesser punishment.

but not in my case [no] oh no.....

Here the fine itself wouldnt get higher, but if you lose you'd have to pay for the costs for the trial. So you'd end up with several hundreds of Euros if you lose. Thats why people here usually just pay the fine.

Why does it cost so much? Here, you usually just appear before a magistrate and the matter can be settled in a matter of 15 minutes or so, unless you wish to fight it further.
