OK, I just found something out that adds a slightly different twist to this conversation.

Anyone receiving tips as part of their wages, must be paid at least $2.13 per hour, outside of the tips (as their base). If the total tips do not then make up the different between this and the minimum wage ($6.85 per hour I believe), then the employer must make up the difference. This is federal law.

Therefore, anyone earning tips will always earn at least the minimum wage, regardless of whether you tip or not.

Yeah I was actually going to mention this myself. Not sure about the minimum wage though, is that what's federally mandated now? I know some states have laws where it's higher than the federal minimum too, so of course it's complicated...

Is this just for New York or every state?

Every state. Those of you in the US really should read the US Labor Law posters they have to put in your break room at work the next time you're bored...

In Europe, there is almost no recourse for bad service, in the States you can hit them in the pocketbooks for it Sure there is, bad reputation and customers not returning (which equates to a loss of income eitherway).

Where I live you'd have to be a really bad waitress to not make decent money. I've yet to meet a single decent waitress who didn't pull in fair money. Not to mention the smart ones cheat on their taxes.

Then again... the city is full of fat people. We're a freaking food test market. Took the wife to Texas Roadhouse last night. Damn that was good.
