Basically, a woman's word that she was raped, even in the absence of physical evidence and even months after the alleged rape, was enough to get his client put on trial. I think the prosecutors realize they don't have much of a case for second-degree murder. There's just not enough evidence to convict. You have one witness, the suspect, who was clearly hit by the victim (broken nose, cuts on back of the head) and no evidence that the guy is racist. You might be able to get him on involuntary manslaughter, maybe.
