Assalamu alaikum,
I want to know from the knowledgeable ulema on this forum like Mufti Husain if we can use the book al-Majallah for fiqh of business transactions. I want to know if the rulings are reliable and permissible to use. Shaykh Faraz gave some comments here: http://qa.sunnipath.com/issue_view.a...D=1800&CATE=91 Also a translation is available here: http://www.iiu.edu.my/deed/lawbase/a...lle/index.html Recently there have been a lot of translations of Hanafi works like Nur al Idah and Hidayah, but none of it actually covers fiqh of business transactions in details except for Beheshti Zewar. Now the thing with Beheshti Zewar is that even though it has detailed compilations of various rulings it does not list the general principles like in Nur al Idah or in Taleemul Haq regarding the other matters of the deen. One of our teachers highly recommended it and I also noticed that Mufti Taqi Usmani references it quite a bit in his on book on Islamic Finance.
Which commentary would you recommend? jazakAllah khayr. |

Which commentary would you recommend? ![]() The two best commentaries are those of al-Attasi and Ali Haydar. The first is printed by Rashidiyyah in Kweta and available throughout Pakistan and is titled "Sharh Majallah al-Ahkam". It is ultra-rare in the Arab world. The second is very common and has been printed a number of times. It is titled "Durar al-Hukkam". The Dar al-Jil and the Ilmiyyah editions are the most common. The second is written in a very orthodox manner, clarifying the text and mentioning related masail, without much research involved. This would be recommended for most Ulama. The first - Attasi's Sharh" is a muhaqqaq work, full of research, with him differing with many authorities before him-including Ibn Abidin- on a myriad of issues and is recommended for those who are well-versed in Fiqh and able to fully grasp his research and sift through what is acceptable from what isn't. |

Does anyone have any comments on this edition of Dar Ibn Hazm?
Also, is the commentary of Salim Rustum Baz beneficial? It seems fairly common. Finally, can someone tell me which sharh this is? I can't make it out. Jazakum Allahu khayra |

Does anyone have any comments on this edition of Dar Ibn Hazm? طبعات «المجلة»: طبعت «المجلة» مراراً باللغة التركية، أما الطبعات العربية، فالطبعة الأولى كانت بمطبعة الجوائب سنة 1297هـ/1880م ثم تبعتها عدة طبعات حتى صدرت طبعة الهواويني بدمشق سنة 1923م، وهي المعتمدة المتداولة اليوم. ثم صدرت عن دار الجفان والجابي بقبرص – مع الاشتراك بدار ابن حزم ببيروت- طبعة مخدومة محققة، بعناية بسام عبد الوهاب الجابي سنة 1424هـ/2004م، وهي طبعة ممتازة، مذيلة بـ «قرار حقوق العائلة». Best print, just reprinted last year, so available in the market again. Also, is the commentary of Salim Rustum Baz beneficial? It seems fairly common. 7- «شرح المجلة»: لسليم بن رستم بن إلياس باز النصراني البيروتي، ت 1338هـ/1920م. طبع مرارا، منها سنة 1304 ثم بإحياء التراث العربي سنة 1406هـ في مجلد كبير وبدار الكتب العلمية في مجلدين. وكان المؤلف من أعضاء شورى الدولة العثمانية وعلى شرحه تقريط بقلم العلامة أحمد جودت باشا. وشرحه وجيز، اقتصر فيه على ما مست إليه الحاجة، بغير تطويل وإطناب، وقد أكثر فيه اعتماده على حاشية ابن عابدين. I can't make it out. 1- «شرح القواعد الكلية مع كتابَيْ البيوع والإجارة» (تشريح شرح المجلة): لعبد الستار أفندي بن عبد الله القريمي الحنفي، تولى قضاء مكة المكرمة، وتوفي فيها سنة 1304هـ. ألفه بالعثمانية وترجمه إلي العربية د. إلياس مطر. طبع باستانبول سنة 1299هـ/1882م. |
