I have a friend who lives in Uk...and he likes a girl who is 16 years old...in fact both of them like each other..they wanted to get married ....but the rules of UK say that you need to be 18 or above that to be legally married...otherwise my friend might end up in jail for Statutory rape..or any thing like that??.i wanted to ask what are the ruling of shariah regarding this.?? what is the age at which a girl can get married? doesn't it allow if the girl has reached puberty?? the guy can wait 2 years...its no hurry....but he wanted to know what islam has to say ...and he asked me ..so i asked here.... Also I want to ask what is the minimum age difference that is required according to islam?he told me in Uk things are quite different ...you get a lot of labels which i don't like to name here... any help would be appreciated |

Does the Islamic ruling matter if the legal UK ruling says that she must be 18? (I do not know UK laws on marriage to minors.) If he is jailed for marrying her before 18, I can't imagine the courts would rule in his favor under that claim that it is fine in his religion. So, if he must wait for her to turn 18 according to the laws of the country, then does it matter if Islamic laws allow it?

You can always get married under Islam with a Sheikh (Katb-Kitab) and then just wait until they are of age to get married "legally" in the UK. If the UK government doesnt recognize islamic rule then why do they worry about an islamic nikah? They should only worry if an underage marriage takes place according to their system. |

Thanks for the detailed reply ....all of you....well i have told him to wait for 2 years...it ain't a big time....and this exactly what he was actually thinking of....The reason of him asking me whether it's allowed in islam or not...was to make sure..what he is doing is right or wrong from Islamic point of view....because he told me even if you are roaming or talking with a girl of 16 years old in UK and you are 21-22 years of age(who may have reached puberty of course and in most cases she has)its looked upon with disgust....well it may sound quite absurd or weird (although islam may allow it) that a 16 year old is getting married to 30 year old man....because the age difference will play a role in their long term relationship..But i have seen a lot of couples with 4-5 years of difference of age gap...some even extending to 10-15 years...and most got married when they were young..
secondly as its quite interesting to note...i did some search on the net....and found that age of consent in uk is 16 for a girl...age of consent is @ which she can have an intimate relation (without marriage of course)....and a more interesting fact that i came across is that the person with whom she can have a relation must be within 3-4 years of HER age that is 19 years of age MAX...(other wise the person will be charged of child abuse or statutory rape)... so it would be worthy of noting the implications of society/laws/and religion ....i mean does islam consider a woman under 18 as a child or a minor....or girl becomes a women..the moment the puberty is reached..??? |

erm he shouldnt be discussing any of this with the girl...any form of contact with her is haraam...he should be talking to her walis about this....if everything is done through her wali in the correct manner then despite the age-gap people will not make such a big deal out of it...however if its done without the knowledge of walis then people will assume he has taken advantage of a young girl

Or is there a difference of opinion on that? yah she can get married with parental consent @ 16...i'll ask him what's the problem with that...BUT i would also like to know the answer of this question ...can any knowledgeable person answer this Isn't parental consent required in Islam also at that age? for what i know the ability to make decisions (such as marriage) in uk occurs @ age 18 what is the Islamic criterion of making one's own decisions (such as marriage)?? is it 18 ,16 or when the puberty is reached...? Also you wouldn't have to worry about the law getting them into any trouble if they married according to Islam because usually statutory rape occurs when the parents find out about their daughter dating a 20 year old or something. Also Allah will protect them. I actually encourage this marriage to happen as soon as possible as long as they both want to, the parents accept, the couple are matured in their deen and the man has a future and will be able to support, protect, and raise a strong Muslim family. There was also a case ...when with parents consent the two got married ...like a similar situation here...later on due to some rift within the family....they accused the husband of statutory rape...He ended up in jail... |
