Default Regarding the (Farl & Sunnah) Fastings!
Assalamu alaikum Dear Brothers/Sisters,

Can we do Miswakh and use Aththars (Non alcoholic Perfumes) while fasting? Because some say that "we can't make miswakh and use perfumes while fasting times as well" why is that? and some say that "no matter can make miswakh for fulfill our sunnah and also can use perfumes for ignore our sweating smell which makes bother someone while praying together on saff, then can use perfumes while fasting times too etc"...

Please give me a good explanation for this by including sahih hadeeths as the way Nabi Muhammadh (S.A.W) used to do in his life....

It is sunnah to make miswak while fasting. However, it is makrooh (disliked) to use flavored miswak that has artificial taste added to it.

I was wondering if brushing with miswaak allowed (which has a taste to it), why isnt brushing with tooth paste allowed?
It is permissible to make miswak while fasting. To use tooth paste in the
state of fasting is Makrooh (disliked). The minimum taste in the miswak is
inlike the strong taste in the paste. Furthermore the paste is a solid
substance and liquidifies more in the mouth thereby having the potential of
going down the throat.

after zawal it is makrooh to make siwaak, unless one wishes to remove the taste or smell of sleep from the mouth. & one must make sure not to swallow the saliver because anything that mixes with ones saliver breaks the fast when saliver is swallowed, even the colour on cotton thread if it comes out when one wets it in the mouth would break the fast.

this is for the shafi' madhab, I cant find rulings dealing with atar, but I can tell you that it would not break the fast because you cant break your fast through the skin under normal circumstances.

Is it forbidden to use perfume while fasting?

Answer

The Shāfi‘ī school states that it is recommended for the one fasting to refrain from all forms of luxuries and desires. This would include the application and smelling of perfumes2. They would in all probability be taking their cue from the hadith narrated by Imam al-Bukhari on the authority of Abu Hurayrah that the Prophet sallAllahu alayhi wasallam said:

Fasting is a shield. [Let the person observing fast] not commit rafath (conjugal relations) and let him not behave ignorantly and impudently … [Allah subhānahu wata‘ālā says], ‘He [the fasting person] has left his food, drink and desires for My sake. The fast is for Me and I will [personally] reward [the fasting person] for it. And each good deed is multiplied ten times.

In another version of the hadith of Abū Hurayrah narrated by ibn Khuzaymah in his Sahih, Rasulullah sallAllahu alayhi wasallm says, “He [the fasting person] leaves his luxuries (ladhdhatahū) for My sake…”

Consequently in keeping with these traditions, the jurists advised the fasting person to refrain from all sorts of luxuries and desires, even though permissible and encouraged at other times, similar to the muhrim or the one in a state of ihram.
